MBS CLOUD, LLC, a Texas limited liability company (“MBS” or the “Company”), respects your privacy and is committed to protecting it through our compliance with the terms set forth in this Privacy Policy (this “Policy”), effective as of March 8, 2022.
Section 1
Introduction and Scope
This Policy describes the types of information MBS may collect from you, or that you may provide, when you utilize the Services and/or visit the Website (as defined below), and our practices for collecting, using, maintaining, protecting, and disclosing such information.
1.1 Information Covered by Policy. This Policy applies to information that MBS collects:
(a) on the MBS website at www.mbssecure.com (along with other domain names and subdomains affiliated therewith, collectively, the “Website”);
(b) through your use of the hosting, infrastructure, desktop, virtual private network (“VPN”), and other services known as The Complete CloudTM (collectively, the “Services”);
(c) in email, text, and other electronic messages between you and this Website;
(d) through applications you download from the Website, which provide dedicated non-browser-based interaction between you and this Website;
(e) when you interact with advertising and applications on outside websites and services, if those applications or advertising include links to this policy; and
(f) via software agents installed by MBS in conjunction with the Services.
1.2 Information Excluded from Policy. This Policy does not apply to information collected by:
(a) MBS offline or through any other means, including on any other website operated by MBS (or its Affiliates) or any third party; or
(b) any third party, including through any application or content (including advertising) that may link to or be accessible from or on the Website.
Please read this Policy carefully to understand the Company’s policies and practices regarding your information and how MBS will treat it. If you do not agree with these policies and practices, the choice not to use the Website is yours. By accessing or using this Website, you agree to this Policy. This Policy may change from time to time (see Section 9). Your continued use of the Website after MBS makes changes is deemed to be acceptance of those changes, so please check the Policy periodically for updates.
Section 2
Children Under the Age of 16
The Website is not intended for children under 16 years of age. No one under age 16 may provide any personal information to or on the Website. MBS does not knowingly collect personal information from children under 16. If you are under 16, do not use or provide any information on this Website or through any of its features, register on the Website, make any purchases through the Website, use any of the interactive or public comment features of this Website, or provide any information about yourself to MBS, including your name, address, telephone number, email address, or any screen name or username you may use. If MBS learns that personal information from a child under 16 has been collected or received without verification of parental consent, MBS will delete that information. If you believe MBS might have any information from or about a child under 16, please contact us at the address set forth in Section 11.

Information About You and How We Collect It
3.1 Types of Information We Collect. MBS collects several types of information from and about users of the Website, including information:
(a) by which you may be personally identified, such as name, address, e-mail address, telephone number, social security number, or any other identifier by which you may be contacted online or offline (collectively, “Personal Information“);
(b) that is about you, but individually does not identify you; and/or
(c) about your internet connection, the equipment you use to access the Website, and usage details.
3.2 How We Collect Information. MBS collects this information:
(a) directly from you, when you provide it to MBS;
(b) automatically as you navigate through the Website, which includes but may not be limited to usage details, IP addresses, and information collected through cookies, web beacons, and other tracking technologies; and
(c) from third parties, such as our business partners.
3.3 Information You Provide to MBS. The information MBS collects on or through our Website may include:
(a) information that you provide by filling in forms on the Website, including information provided at the time of registering to use the Website, subscribing to the Services, posting material, or requesting further services;
(b) information when you report a problem with the Services or Website;
(c) records and copies of your correspondence, including email addresses, if you contact MBS;
(d) your responses to surveys or questionnaires that MBS from time to time might ask you to complete for research purposes;
(e) details of transactions you carry out through the Website and of the fulfillment of your orders, in which case you may be required to provide financial information before placing an order through the Website; and
(f) your search queries on the Website.
3.4 Information Published to Public Areas. You also may provide information to be published or displayed (hereinafter, “posted“) on public areas of the Website, or transmitted to other users of the Website or third parties (collectively, “User Contributions“). Your User Contributions are posted on and transmitted to others at your own risk. Although MBS limits access to certain pages, please be aware that no security measures are perfect or impenetrable. Additionally, MBS cannot control the actions of other users of the Website with whom you may choose to share your User Contributions. Therefore, MBS cannot and does not guarantee that your User Contributions will not be viewed by unauthorized persons.
3.5 Automatic Data Collection. As you navigate through and interact with our Website, MBS may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:
(a) details of your visits to our Website, including traffic data, location data, logs, and other communication data and the resources that you access and use on the Website; and
(b) information about your computer and internet connection, including your IP address, operating system, and browser type.
We also may use these technologies to collect information about your online activities over time and across third-party websites or other online services (i.e., “behavioral” tracking).
3.6 How MBS Uses Data Automatically Collected. The information MBS collects automatically may include personal information, but we may maintain it or associate it with personal information MBS collects in other ways or receives from third parties. It helps MBS improve the Website and deliver a better and more personalized service, including by enabling MBS to:
(a) estimate our audience size and usage patterns;
(b) store information about your preferences, allowing MBS to customize the Website according to your individual interests;
(c) speed up your searches; and
(d) recognize you when you return to the Website.
3.7 Technology Used in Data Collection. The technologies MBS uses for this automatic data collection may include:
(a) Browser Cookies. A cookie is a small file placed on the hard drive of your computer. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting you may be unable to access certain parts of the Website. Unless you have adjusted your browser setting so that it will refuse cookies, the MBS system will issue cookies when you direct your browser to our Website.
(b) Flash Cookies. Certain features of the Website may use local stored objects (or Flash cookies) to collect and store information about your preferences and navigation to, from, and on the Website. Flash cookies are not managed by the same browser settings as are used for browser cookies. For information about managing your privacy and security settings for Flash cookies, see Section 6.
(c) Web Beacons. Pages of the Website and e-mails from the Company may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit MBS, for example, to count users who have visited those pages, opened an email, and for other related website statistics (e.g., recording the popularity of certain content and verifying system and server integrity).
MBS does not collect personal information automatically, but we may tie this information to personal information about you that MBS collects from other sources or that you provide to us.

Third-Party Use of Cookies (and Similar Technology)
4.1 Overview. Some content or applications, including advertisements, on the Website are served by third parties, including advertisers, ad networks and servers, content providers, and application providers (collectively, “Third Parties”). These Third Parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use the Website. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites and other online services. Third Parties may use this information to provide you with interest-based (behavioral) advertising or other targeted content.
4.2 MBS Lack of Control. MBS does not control Third Parties’ tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly. For information about how you can opt out of receiving targeted advertising from many providers, see Section 7.

How MBS Uses Your Information
5.1 Scope. MBS uses information collected about you or that you provide to MBS, including any personal information:
(a) to present the Website and its contents to you;
(b) to provide you with information, products, or services that you request from MBS;
(c) to fulfill any other purpose for which you provide it;
(d) to provide you with notices about your account or subscription, including expiration and renewal notices;
(e) to carry out our obligations and enforce our rights arising from any contracts entered into between you and MBS, including for billing and collection;
(f) to notify you about changes to the Website or any products or services we offer or provide though it;
(g) to allow you to participate in interactive features on the Website;
(h) in any other way MBS may describe when you provide the information; and
(i) for any other purpose(s) with your consent.
5.2 Additional Goods and Services. MBS may also use your information to contact you about goods and services that may be of interest to you. If you do not want MBS to use your information in this way, please adjust your user preferences in your account profile. For more information, see Section 7.
5.3 Advertisements. MBS may use the information collected from you to enable MBS to display advertisements to our advertisers’ target audiences. Even though MBS does not disclose your personal information for these purposes without your consent, if you click on or otherwise interact with an advertisement, the advertiser may assume that you meet its target criteria.
Section 6
Disclosure of Your Information
6.1 Aggregated Information. MBS may disclose aggregated information about our users, and information that does not identify any individual, without restriction.
6.2 Personal Information. MBS may disclose personal information that MBS collects or you provide as described in this Policy:
(a) to our subsidiaries and affiliates;
(b) to contractors, service providers, and other third parties MBS uses to support our business and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which it was disclosed;
(c) to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of the Company’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by MBS about the Website users is among the assets transferred;
(d) to third parties to market their products or services to you (in which case, MBS contractually requires these third parties to keep personal information confidential and use it only for the purposes for which MBS discloses it to them);
(e) to fulfill the purpose for which you provide it;
(f) for any other purpose(s) disclosed by MBS when you provide the information; and
(g) with your consent.
6.3 Legal Matters. In addition to the other disclosures set forth in this Section 6, MBS may also disclose your personal information:
(a) to comply with any court order, law, or legal process, including to respond to any government or regulatory request;
(b) to enforce or apply our Terms of Service and other agreements, including for billing and collection purposes; and
(c) if MBS believes disclosure is necessary or appropriate to protect the rights, property, or safety of the Company, our customers, or others (including exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction).
Section 7
Choices About How We Use and Disclose Your Information
MBS strives to provide you with choices regarding the personal information you provide. To this end, MBS has created mechanisms to provide you with the following control over your information:
7.1 Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. To learn how you can manage your Flash cookie settings, visit the Flash player settings page on Adobe’s website. If you disable or refuse cookies, please note that some parts of the Website may then be inaccessible or not function properly.
7.2 Targeted/Third-Party Advertising. If you do not want MBS to (i) share your personal information with unaffiliated or non-agent third parties for promotional purposes, or (ii) use information that we collect to deliver advertisements according to our advertisers’ target-audience preferences, you can opt-out by sending us an email with your request to the address set forth in Section 11.
7.3 Promotional Offers. If you do not wish to have your contact information used by MBS to promote our own or third parties’ products or services, you can opt-out by sending us an email stating your request to the address provided in Section 11. If MBS has sent you a promotional email, you may send us a return email asking to be omitted from future email distributions. This opt-out does not apply to information provided to MBS as a result of a product purchase, warranty registration, product service experience, or other transactions.
7.4 Opting Out of Certain Targeted Ads. MBS does not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative (the “NAI”) on the NAI’s website.
Section 8
Accessing and Correcting Your Information
8.1 Requests to Delete Personal Information. You may send MBS an email at the address set forth in Section 11 to request access to, correct, or delete any personal information that you have provided to MBS. MBS cannot delete your personal information except by also deleting your user account. MBS may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.
8.2 User Contributions. If you delete your User Contributions from the Website, copies may remain viewable in cached and archived pages, or might have been copied or stored by other Website users. Proper access and use of information provided on the Website, including User Contributions, is governed by our Terms of Service.
Section 9
Data Security
9.1 Security Features. MBS has implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to MBS is stored on our secure servers behind firewalls. MBS encrypts all payment transactions using SSL technology.
9.2 User Actions. The safety and security of your information also depends on you. Where MBS has given you (or where you have chosen) a password for access to certain parts of the Website, you are responsible for keeping this password confidential. MBS asks you not to share your password with anyone, and urges that you to be careful about giving out information in public areas of the Website like message boards. The information you share in public areas may be viewed by any user of the Website.
9.3 Information Disclosed Online. Unfortunately, the transmission of information via the internet is not completely secure. Although MBS strives to protect your personal information, MBS cannot guarantee its security when transmitted to the Website. Any transmission of personal information is at your own risk, and MBS is not responsible for circumvention of any privacy settings or security measures contained on the Website.
Section 10
Changes to Our Privacy Policy
It is the policy of MBS to post any changes to this Policy on this page, along with a notice on the Website home page. If MBS makes material changes to how we treat our users’ personal information, MBS will notify you by email to the email address specified in your account. The date this Policy was last revised is identified at the top of the page. You are responsible for ensuring MBS has an up-to-date active and deliverable email address for you, and for periodically visiting the Website and this Policy to check for any changes.
